Il potere dell'Amministrazione di avvalersi dell'art. 32 bis, se ben può essere esercitato anche successivamente all'intervenuto giudicato formatosi sull'annullamento della procedura espropriativi, trova, comunque, un insuperabile ostacolo nell'ordine del giudice di restituzione dell'immobile, intervenuto in precedenza nei confronti dell'Amministrazione, ossia prima che questa adottasse il provvedimento acquisitivo.
L'utilizzo del bene immobile, che ai sensi dell'art. 32 bis L.P. n. 10/1991 costituisce condizione necessaria della procedura acquisitiva, non può essere ricondotto, sic et simpliciter, alla mera disponibilità dello stesso e non può assumere rilevanza quando sia riconducibile ad un accadimento configurabile come illecito civile, ossia ad un comportamento illecito, cosciente e volontario, nella specie, nella forma dell'omissione, quale inosservanza ad un ordine del giudice di restituire l'immobile al proprietario.
