Ricorso gerarchico - decisione di inammissibilità consegue solo a questioni procedurali -tutela del paesaggio - non spetta alla Provincia sindacato sulla rispondenza delle costruzioni alla normativa urbanistica

La pronuncia di inammissibilità del ricorso amministrativo consegue solo a questioni procedurali (quali l'inoppugnabilità del provvedimento, la tardività del gravame, il difetto di competenza dell'organo adito, ecc…) e non può aver luogo quando sussistano questioni di merito sollevate dal ricorrente, ciò che può invece rilevare ai fini di una eventuale reiezione del ricorso. In questo caso una decisione che dichiari l'inammissibilità dell'impugnativa violerebbe il principio generale di cui all'art. 112 c.p.c. relativo alla necessaria corrispondenza tra il chiesto ed il pronunciato.
 
Alla Provincia autonoma di Bolzano, in sede di tutela del paesaggio, non spetta il sindacato sulla rispondenza delle costruzioni alla normativa urbanistica, ma quello sul rapporto delle singole costruzioni con l'ambiente ed il paesaggio.
