In tema di appalti pubblici gode di tutela giurisdizionale anche il c.d. interesse strumentale, che esiste nei casi in cui le censure rivolte nei confronti di una procedura conducano all'annullamento dell'intera gara. Invero, sussiste interesse a ricorrere anche quando l'annullamento dell'atto lesivo comporti l'obbligo per l'Amministrazione, in seguito alla rimozione dell'atto illegittimo, di riesaminare la situazione e di emanare altri provvedimenti che siano eventualmente idonei a garantire al privato un risultato favorevole.
 
La P.A., nel caso in cui decida di indire una trattativa privata per la scelta del contraente autovincolandosi ad una determinata procedura (gara informale), non può disattenderla accordando liberamente la preferenza all'una o all'altra tra le offerte presentate, al di fuori delle regole che l'Amministrazione stessa si è preliminarmente data.
 
In una pubblica gara, i criteri di valutazione delle offerte devono essere fissati prima della conoscenza delle stesse e quindi l'apertura dei plichi contenenti le offerte deve, per principio generale, precedere la determinazione dei criteri di scelta tra i vari offerenti.
