La mancata comunicazione a tutti i confinanti del progetto edilizio depositato, prevista dall'art. 3 del Regolamento edilizio del Comune di Bolzano, non è idonea a provocare l'annullamento della concessione edilizia se può essere provato che l'assemblea condominiale era comunque a conoscenza del progetto.
 
Negli edifici in condominio i proprietari esclusivi delle singole unità immobiliari possono utilizzare i muri comuni, nelle parti ad esse corrispondenti, sempre che l'esercizio di tale facoltà, disciplinata dagli artt. 1102 e 1122 c.c., non pregiudichi la stabilità ed il decoro architettonico del fabbricato, in quanto in tal caso ciascun proprietario ha diritto di trarre dal bene comune una utilità maggiore e più intensa di quella che ne viene tratta dagli altri comproprietari, purchè non venga alterata la destinazione del bene o compromesso il diritto al pari uso da parte di quest'ultimi
